Terms of Service

By accessing or using this platform, you ("User") agree to be bound by these Terms and Conditions. If you do not agree, you may not use the platform. These terms apply to all users, including Brand Managers and Marketing Team members.

This platform is a proprietary, desktop-based online tool that enables authorised users to upload brand assets (SVG, PNG, JPEG) and assemble creative advertisements for:

• Facebook and LinkedIn digital campaigns
• Print media production
• Other approved marketing outputs

The platform is intended for internal brand and marketing use only and is not a public-access service.

Access is granted on an invitation-only basis. Two user roles exist:

• (ADMIN) Brand Manager — authorised to upload, manage, and approve brand assets.
• (USER) Marketing Team Member — authorised to assemble and export approved creative assets.

Users may not share login credentials, grant access to unauthorised parties, or use the platform outside their assigned role.

All software, interfaces, workflows, algorithms, and design elements of this platform are the exclusive intellectual property of the platform owner and are protected under applicable copyright, trademark, and trade secret law.

• You may not copy, reverse-engineer, decompile, or reproduce any part of this platform.
• You may not re-sell, licence, or distribute the platform or any derivative thereof.
• Unauthorised reproduction or cloning of this platform constitutes a breach of these terms and may result in legal action.
• Brand assets uploaded by users remain the intellectual property of their respective owners. The platform owner claims no rights over uploaded content.

Users are solely responsible for the content they upload. By uploading assets, you confirm that:

• You own or have the necessary rights and licences to use the assets.
• The content does not infringe any third-party copyright, trademark, or intellectual property right.
• The content is not unlawful, defamatory, or in violation of any applicable law.

The platform owner accepts no liability for infringing content uploaded by users.

Uploaded files are processed solely for the purpose of asset assembly and export. The platform owner will not:

• Share, sell, or distribute uploaded brand assets to third parties.
• Retain files beyond the active session unless explicitly required for saved project functionality.

All data is transmitted over secure encrypted connections. Users are responsible for the security of their login credentials.

Users may not use this platform to:

• Assemble or distribute unlawful, misleading, or defamatory advertising content.
• Upload malware, corrupted files, or malicious code of any kind.
• Attempt to bypass platform security, access controls, or usage restrictions.
• Use automated tools to scrape, extract, or replicate platform functionality.
• Reproduce or clone any part of the platform software or interface.

PDF and image exports generated on this platform are for use in approved marketing channels only. The platform owner is not responsible for:

• Print quality, colour accuracy, or production outcomes from exported files.
• Rejection of exported files by third-party platforms (Facebook, LinkedIn, print houses, etc.).
• Any errors in the final output resulting from incorrect asset placement by the user.

To the fullest extent permitted by law, the platform owner shall not be liable for any direct, indirect, incidental, or consequential loss arising from:

• Use or inability to use the platform.
• Loss, corruption, or unauthorised access to uploaded files.
• Errors in exported PDF or image output.

The platform is provided "as is" without warranties of any kind, express or implied.

The platform owner reserves the right to suspend or terminate any user's access at any time, without notice, for:

• Breach of these Terms and Conditions.
• Misuse or abuse of the platform.
• Any activity that poses a risk to the platform, other users, or third parties.

These Terms and Conditions may be updated from time to time. Users will be notified of material changes. Continued use of the platform after notification constitutes acceptance of the revised terms.

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from the use of this platform shall be subject to the jurisdiction of the South African courts.
